GoZen Inbound 360 – Terms and Conditions
These Terms and Conditions govern your use of the GoZen Inbound 360 service provided by GoZen Technologies (“we,” “our,” or “us”). By accessing or using the Service, you agree to comply with and be bound by these Terms.
1. Acceptance of Terms
By accessing or using GoZen Inbound 360, you acknowledge that you have read, understood, and agree to be bound by these Terms and any policies incorporated by reference. These Terms form a legally binding agreement between you and GoZen Technologies.
We may update these Terms at any time. Material changes will be communicated via email or in-app notification at least 15 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
2. Definitions
- Service: All products and features provided by GoZen Inbound 360.
- User: Any individual or entity using the Service, whether on a free or paid plan.
- Account: A registered user profile enabling access to the Service.
- Subscription: A paid plan that provides additional features and capabilities.
- Content: Any text, files, data, or materials uploaded or created by you within the Service.
3. User Eligibility
- You must be at least 18 years old (or the legal age in your jurisdiction) to form a binding contract.
- If using the Service on behalf of an organization, you must have authority to bind that organization.
- We may restrict access based on geographical location or other criteria.
4. Account Registration & Security
- You must provide accurate, complete, and up-to-date information when creating an Account.
- You are responsible for keeping your login credentials secure and for all activities under your Account.
- Notify us immediately if you suspect unauthorized use of your Account.
- We may suspend or terminate Accounts that violate these Terms or disrupt the Service.
5. Use of the Service
We grant you a limited, non-exclusive, non-transferable license to use the Service for lawful purposes.
You agree not to:
- Attempt unauthorized access to systems, servers, or data.
- Distribute harmful content (malware, spyware, viruses).
- Harass, defame, or threaten others.
- Use the Service for illegal purposes, including fraud or IP violations.
6. Subscriptions & Payments
- GoZen Inbound 360 offers free and paid subscription plans.
- Fees and billing cycles (monthly or annual) are shown on our website.
- Payments are made via credit/debit card or other accepted methods.
Refund Policy
Payments are non-refundable, except as required by law. However:
- We offer a 7-day free trial. If you do not cancel your subscription within this period, you will be automatically charged. To cancel your account, please contact our support team via live chat or email [email protected]
- New subscribers may request a refund within 7 days of purchase if unsatisfied.
- Refunds may also be issued in cases of billing errors or prolonged service outages.
Automatic Renewal
Your subscription will automatically renew at the end of each billing cycle.
- We will notify you in advance of renewal charges by email or in-app.
- You may cancel auto-renewal anytime in your Account settings.
7. Content Ownership & Rights
- You retain ownership of all Content you upload or create.
- You grant us a worldwide, royalty-free license to use, process, and store your Content only to operate and improve the Service.
- GoZen retains ownership of its technology, tools, and platform. You may not copy, reverse-engineer, or resell the Service.
8. Privacy & Data Protection
- We process personal data according to our Privacy Policy.
- We may collect personal details, communication data, and technical information (e.g., IP address, analytics).
- If you are located in the EU or California, we comply with GDPR and CCPA respectively.
- The Service may integrate with third-party tools. These are governed by their own terms and privacy policies.
9. Termination & Data Access
We may suspend or terminate your Account if:
- You violate these Terms.
- Subscription fees are unpaid.
- You engage in harmful or illegal activities.
Upon termination:
- Your access will end, but you will have 30 days to download or export your Content before permanent deletion (unless prohibited by law).
10. Indemnification
You agree to indemnify and hold harmless GoZen Technologies against claims arising directly from:
- Your misuse of the Service.
- Your violation of these Terms.
This does not apply to claims caused by GoZen’s own negligence, fraud, or willful misconduct.
11. Limitation of Liability
- GoZen is not liable for indirect or consequential damages (e.g., lost profits, lost data).
- Our maximum liability is limited to the fees you paid in the 12 months before the event causing the claim.
- This limitation does not apply in cases of gross negligence, fraud, or willful misconduct by GoZen.
12. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of New Jersey, United States, without regard to conflict-of-law principles.
Disputes shall be resolved by binding arbitration in Morris Plains, New Jersey, USA, in accordance with the rules of the American Arbitration Association (AAA).
For users located in India, disputes may alternatively be resolved by binding arbitration in Coimbatore, Tamil Nadu, India, in accordance with the rules of the Arbitration and Conciliation Act, 1996 (India).
13. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in effect.
14. Entire Agreement
These Terms, along with our Privacy Policy and referenced policies, form the entire agreement between you and GoZen Technologies regarding the Service.
