Our Service

Gozen is an email marketing service that lets you create, send, and track email campaigns as well as gather leads through forms. You can import contacts from third-party applications or any contact database

Eligibility and Authorization

• You must be at least 16 years old.
• Should provide proper contract and billing details.
• Accept the terms and conditions.

If you are using our Services on behalf of another person or entity, you acknowledge that you are allowed to accept these Terms on their behalf and that the other person or entity agrees to be accountable to us if you or the other person or entity violates these Terms.

Terms

The Agreement between you and Gozen is created when you sign up for an account and agree to these Terms, and the duration of the Agreement (the “Term”) begins. The Term will last as long as you have a Gozen account or until you or we terminate it in line with these Terms, whichever comes first. If you create an account on behalf of a company or other entity, you represent and warrant that you have the authority to accept these Terms and enter into the Agreement on that entity’s behalf.

General Rules

Unsolicited email is known as “spam” and is prohibited. and You must use our Service in accordance with all applicable rules and regulations, and you are not authorised to use our tracking/campaign preview links while sending emails using other services besides ours. You represent that you are authorised to accept these Terms on behalf of your company if you access or use the Services on behalf of your company, and all references to “you” or “Customer” pertain to your company.

We may suspend or delete your account if you break any of these policies.

Account : security and Electronic communications

For using some or all of our services, you will need to create an account. If you create an account, you must enter accurate account information and update it as soon as possible if it changes. You must also keep your account secure, not share your password, and contact us immediately if you discover or suspect that someone has accessed your account without your permission.

You consent to receive electronic communications from Gozen by creating a Gozen account (e.g., via email or by posting notices on our Services). These communications are part of your relationship with us and may contain notices regarding your account (e.g., payment authorizations, password changes, and other transactional information). You agree that any notices, agreements, disclosures, or other communications sent to you electronically will satisfy any legal communication requirements, including but not limited to the requirement that such communications be in writing.

Closing your account

You or Gozen may end the Agreement at any time and for any reason by closing your Gozen account or giving the other party notice. We reserve the right to suspend the Service to you at any moment, for any reason. If your account is a paid account, we’ll refund a prorated portion of any prepaid sums for the Service (including a Monthly Plan) or compensate you for unused Pay as You Go Credits if we terminate your account without cause. In any other circumstance, including if your account is suspended or terminated for cause, such as a breach or violation of the Agreement, we will not refund or reimburse you. You recognise and agree that if your account is cancelled, we may permanently erase your account and all data linked with it, including your Campaigns. Usernames are one-of-a-kind and can be used just once. Your username will no longer be available for use on any future accounts if your account is cancelled, and it cannot be restored.

Payment

Payment is not made until the service is provided. The monthly plan payment period is one month and the payment duration is one year. The monthly plan can be paid with a credit or debit card. We do not accept cash, cheques or any other form of payment.

Our charges for the Service and other services are available at https://gozen.io/#pricing. VAT and other taxes are not included in the prices. We have the right to change or adjust our pricing at any moment.

Refund

If we discontinue offering the Service and terminate your account without cause, we will give you a prorated refund for any prepaid amounts for the Service (including a Monthly Plan) or reimburse you for any unused Pay as You Go Credits. Under any other circumstances, you will not be eligible for a refund or credit from us. We may give a refund, rebate, or credit at our sole discretion.

Email Practices

Email Consent

Permission-based subscriptions must be used for all email lists contained in and delivered to utilising Service. Using a list that has been purchased, rented, or obtained from a third-party is not appropriate or authorised.

Gozen maintains the right to suspend or cancel any account that is found to be in violation of its Terms of Service by receiving more abuse complaints than is permitted, without notice or reimbursement.

Email Format

• Name and address of the sender, as well as the legal form of the entity, authorised representative, and the Commercial Registry, Association Registry, Partnership Registry, or Cooperative Society Registry with which they are registered, as well as the appropriate registration number, for legal entities.

• A valid phone number or electronic contact form, as well as an email address, are required.

• Each newsletter must include an unsubscribe link that allows recipients to opt out of receiving future.

• Unsubscribe links must always be accessible and easy to find for all of your subscribers. The subscriber must be able to cancel their subscription without knowing their login/password. Exceptions may be allowed in exceptional circumstances, such as when the offering party’s administration encounters a snag. It is necessary to process cancellations as soon as possible.

• In the email’s header or topic header, neither the sender nor the commercial nature of the message may be buried or masked. When the header and topic headers are written in such a way that the recipient receives no or only misleading information about the sender’s true identity or the message’s commercial purpose before it is opened and read, this is referred to as obscuring or concealing.

For the sake of clarity, we’d like to note that the organisations that create address data are not permitted to share this data with third parties unless the user expressly authorised it.

Email Content

We only allow you to provide relevant content that users have requested. Gozen does not allow accounts that promote discriminatory, hateful, or harassing content toward others. Also, you may not distribute false content regarding products, services, or other information, such as by hiding or eliminating content or presenting it in an unclear, confusing, or confusing manner.

Gozen also prohibits the distribution of Content that is materially incorrect, inaccurate, or misleading in a way that could deceive or confuse people about key events, issues, or circumstances, as determined by us in our sole discretion.

We may issue a warning, suspend, or terminate your account if you violate any of these rules.

Limitations of Liability

Gozen is not liable or responsible for any losses incurred as a result of your usage of our services. We and our Team will not be liable for any indirect, punitive, special, or consequential damages (including but not limited to loss of use, profits, revenue, income, or anticipated savings, business losses, loss of reputation or goodwill, loss of contracts or business relationships, or loss and/or corruption of information or data) under any circumstances, even if they are caused by negligence or we have been warned of the possibility of such damages. We will not be held accountable for any delays or failures in the performance of any portion of the Service if an event of force majeure prevents or delays us from completing such obligations.

Account Disputes

In the event of an internal issue involving Gozen accounts, you must deal with the other party directly. You may not request information or access to an account to which you do not have access. To safeguard the security and privacy of the data contained inside the account, Gozen maintains the right to suspend any account involved with the disagreement until the dispute is appropriately resolved. Please be aware that in order to suspend your account, we will need a copy of the court judgement or another legitimate document.

Beta Services

From time to time, we may invite you to try products or features related to our Service that are not generally available to all of our Members or the general public, or we may release products or features related to our Service that are labelled as beta, preview, pilot, limited release, or other similar designations in the App (collectively, “Beta Services”). Beta Services may be provided exclusively for the purpose of evaluation or testing, and as a result, they may contain bugs or flaws and may not be as dependable as other aspects of the Service. We reserve the right to stop providing Beta Services at any moment and to refuse to make them widely available. For the avoidance of dispute, Beta Services are considered part of the Service and are therefore subject to the terms of this Agreement.

Changes

Gozen has the right to modify these Terms of Service at any time without notice. This page will be updated if we decide to modify this document. All modifications become effective immediately after they are posted, and we recommend that you review these Terms of Use on a regular basis.
